Battle in court: PTI leader approaches SC for disqualification of PM

ISLAMABAD/KARACHI: The Pakistan Tehreek-e-Insaf (PTI) has approached the Supreme Court seeking the disqualification of Prime Minister Nawaz Sharif under Article 62-F of the Constitution.

The petition was moved by PTI senior leader Ishaq Khan Khakwani under Article 184 (3) of the Constitution. PM Nawaz Sharif and the Election Commission of Pakistan (ECP) have been listed as respondents.

PTI attorney Irfan Qadir prayed the court to disqualify the PM from being a Member of the National Assembly as he gave a false statement in the National Assembly. The petition stated that the PM asked the army chief to act as mediator between government, Imran Khan and Tahir ul Qadri and serve as guarantor to any agreement.
The army chief agreed and met both leaders, who insisted that they would not back off from their demand for Nawaz Sharifs resignation. At this juncture, Nawaz Sharif felt that his plan had not only failed but his move was also not welcomed by certain political quarters. He therefore denied his earlier statement in a session of the National Assembly with the view to malign and damage the fair image of the Army Chief in violation of article 62 [g] by conveying to the people of Pakistan that Army Chief was dealing with such issues without any desire of the Government whereas the fact of the matter is that the army spokesman confirmed that the government had asked the Chief of Army Staff to do so, the petition states.
It is to be noted that Article 62 (f) says that a person shall not be qualified to be elected or chosen as a member of Parliament unless he is sagacious, righteous, non-profligate, honest and ameen, there being no declaration to the contrary by a court of law.
The petitioner contended that Nawaz Sharif stands disqualified in view of the dictum laid down by the Supreme Court in the case relating to disqualification of former Prime Minister Yusuf Raza Gilani wherein court had directed the Election Commission of Pakistan to de-notify PM Gilani from the Membership of the National Assembly of Pakistan.
Similarly, the Sindh High Court (SHC) on Monday issued a notice to the top federal law officer for comments on a petition seeking the disqualification of Prime Minister Nawaz Sharif and Interior Minister Chaudhry Nisar Ali Khan for allegedly making false statements on the floor of the National Assembly.
A division bench headed by Justice Aqeel Ahmed Abbasi directed the attorney general to file such comments by Tuesday (today). The bench was hearing a petition filed by Moulvi Iqbal Haider and Maqsood Ahmed, who named the secretaries of law, justice and parliamentary affairs ministries, the premier, the interior minister, the director general Inter-Services Press Relations (ISPR), the secretary National Assembly, secretary interior, deputy commissioner Islamabad and IG Islamabad police as respondents.
The petitioners alleged that the interior minister stated on the floor of the assembly that the government did not ask the army to play a role in resolving the political stalemate. Minutes later, ISPR issued a statement clarifying that the COAS was asked to play a facilitative role.
The petitioners argued that the premier and interior minister have no right to retain their offices as they are disqualified under Article 62 and 63 since they lied on the Assembly floor. They have attempted to disgrace and defame the top security institution, the petitioner added.
After hearing initial arguments, the bench issued a notice to the attorney general to file comments in this regard today.

Im not an IK supporter but i know very well that IK will not be given any part in this naya pakistan, once this is created. It is being scripted and played by some rogue ex and present army sell outs with very evil plans. PTIians, hell with NS but be very afraid of whats being played in the name of naya pakistan

@SpIDeR your lack of understanding on the matter is astounding.

1) NO PROOF of Imran Khan having any affiliation with Jews. Btw what do you even mean by Jews? Jews is a race of followers who follow Judaism. They reside in many parts of the world. There is no united group called "Jews". If you want to affiliate Imran Khan with "Jews" you need to be specific as to which exact group.

2) Army is neutral. Being a Pakistani I am surprised you would raise the point of army supporting a specific group. The army itself has released clear statements of their neutrality. Even the confused JH retracted his statement.

3) How is taliban using Imran KHan? Taliban itself is a multi-group faction of individuals, each faction having its own agenda. Your statement clearly shows you have no understanding of what Taliban is. You use it as a mere keyword.

4) ISI is using Imran Khan, in what way?

5) Qadri is using Imran Khan, from the very beginning it was clear to everyone that both Dr. Qadri and Imran Khan are fighting against a common enemy. Their tactics and methodology may be different, however it has come in recent view that both are re-aligning their strategy in a common effort to obtain results. Now they are both mutually the same, for this cause ONLY.

6) Supreme Court is with Imran Khan? There is no proof of that, from all we know EX-SCJ (iftikhar) intervened in the election process and over-stepped his bounds to seek a forced result through ROs.

@SpIDeR, your allegations are baseless, my question to you and PML-N supporters is:
A) How is Nawaz Shareef a legiimate PM when the election is unverifiable? No democracy functions this way.
B) Why did Nawaz Shareef lie to the Parliment about COAS?
C) How did Shabaz Shareef remove his name from the FIR the implicated him and his goons of the Model Town killings?
D) Why were containers placed all over Islamabad and Lahore, disrupting residents and most importantly businesses when citizens have the right to protest peacefully?
E) Pre-election Nawaz and SHabaaz promised their voters that they would implicate Zardari in money laundering and bring the millions back into Pakistan. Why now has Zardari and Nawaz reached a common ground in support of each other?
F) Why has the video evidence against Rana Mashhood been ignored by PML-N? This video alone has raised alot of concerns, and digital cryptography and voice analysis show the video to be original.
G) The entire Parliament is out in full support of Nawaz and the current status quo, do you not find that strange? Who is playing the role of opposition?
H) Why did Nawaz and Chaudry Nisar congratulate the punjab police after many protesters were injured and some even killed? Why were media personnel targeted and cars trashed by police officers. No law enforcement agency in any democratic government behaves this way.
I) Why were doctors forced to conceal the stats on injured and killed protesters? In any democratic government there is full transparency

Do you not find things strange in Pakistan? We as a nation are much better then this. We deserve better than two families or the Army ruling us.

Ek aur chawal post. Yeah sub demands except the resignation more or less IK was making from day 1. It took 14 months of knocking on every legal door and then a massive public agitation for Nawazoo to come to this point. Noawaz itna neek aur sharif ( no pun intented ) hota tha phel he 4 halqay khol deta aur election reforms kerdeta.

IK is absolutely right is asking for tind's resignation, infact I think he has shown a lot of flexibility I think he should ask for the entire govt to resign.
