Asghar Khan ruling left no room for ECP to proceed against politicians: CEC

Chief Election Commissioner (ECP) Fakhruddin G Ebrahim said Monday that Supreme Courts ruling in the Asghar Khan petition has not left any room, according to the Constitution, for the commission to carry out proceedings against politicians involved in rigging the 1990 election, Express News reported.

The Supreme Court had ruled that the election, which brought the Pakistan Muslim League-Nawaz to power for the first time at the centre was rigged, with the main part in this played by the military, the ISI and then-president the late Ghulam Ishaq Khan in other words, the establishment.

Speaking to the media in Islamabad, Ebrahim said that after courts ruling, a few politicians urged the ECP to carry out proceedings against politicians who were involved in rigging.

Responding to a question Interior Minister Rehman Maliks dual nationality case, the ECP chief said that the Senate Chairman was supposed to send a reference in the case and that the ECP could only take a decision once it is received.

چیف الیکشن کمشنر جسٹس ریٹائرڈ فخرالدین جی ابراہیم نے کہا ہے کہ اصغر خان کیس پرسپریم کورٹ کے فیصلے کے بعد کسی سیاستدان کیخلاف کاروائی کرنے کی الیکشن کمیشن کے پاس آئینی گنجائش نہیں رہے۔
اسلام آباد میں میڈیا سے گفتگوکرتے ہوئے فخرالدین جی ابراہیم کا کہنا تھا کہ رحمان ملک کی اہلیت سے متعلق چیئرمین سینٹ کا ریفرنس موصول ہونے پر ہی الیکشن کمشن کوئی فیصلہ کرسکتا ہے، انہوں نے مزید کہا کہ چیف جسٹس افتخارمحمد چوہدری سے عام انتخابات میں جوڈیشل افسران کی تقرری کیلئے درخواست کی ہے جس پرچیف جسٹس نے ریٹرننگ افسران کی تعیناتی سے متعلق تعاون کی یقین دہانی کرائی ہے، فخر الدین جی ابراہیم کا کہنا تھا
کہ عام انتخابات میں عالمی مبصرین کو بھی مدعو کیا جائے گا۔

The ruling categorically said that there is insufficient evidence to move agains the politicians who received the money. So the ECP cant act on it. I think though that Sharif should be made an exception as he came into power after all that happened and there is no way he would not have known what was happening.
