What makes you think situation would've been different? Then Aminuddin would be both Head of Constitutional Bench and CJP (both). There is no law that CJP cannot be head of constitutional bench. All Gov members had to do was say that both persons should be same, we have kept unity of power in SC etc.Why the fcuk did he accept the position? If he didn't the story would have been different. They had to appoint either the first two most senior judges or go to Aminuddin Khan. In that case, they have to appoint someone else to become the chief of the judicial committee/court.

What YA could've done was constituted full court to look at 26th Amendment before calling meeting on constitutional bench formation. Another thing Mansoor & CO. could've done was formation of Full Court to review Presidential Ordinance that brought Aminuddin to Practice & Procedure commitee in place of Muneeb Akhtar BEFORE hearing on 63-A was started. Then 63A wouldn't have been reversed and no 26th Ammendment.

Please do let me know when an ordinance effectively pull out Munib out of the judges committee, how can he and Mansoor form a full member bench to review the merits of the ordinance.
