ISLAMABAD: Pakistan Muslim League – Nawaz (PML-N) and Pakistan Tehreek-e-Insaf (PTI) have filed petitions in the Supreme Court against National Assembly Speaker Dr Fehmida Mirza’s ruling in Prime Minister Yousaf Raza Gilani’s contempt verdict, Express News reported on Monday.
PML-N’s petition was filed to the through MNA Khawaja Muhammad Asif. Asif has made Gilani and the Law ministry secretary respondents in the petition.
An earlier report in the The Express Tribune had revealed that the main points of the petition stated that the National Assembly Speaker’s ruling was tantamount to subverting the principles of democracy, equality, and the independence of the judiciary.
The petition questioned whether the speaker’s ruling under Article 63 (2) of the Constitution could defeat the judgment of a seven member bench of the SC which had attained finality and whether this ruling “can flagrantly disregard the rights of all citizens”.
It added that Dr Fehmida’s decision was a “complete violation of the Constitution” and demanded urgent redress under Article 184 (3). The petition further argued that the fundamental right to life, guaranteed by the Constitution, is defined not merely by a physical state but the right to a fulfilling life, including the right to live in a society where the decisions of the SC are enforced.
The PML-N petition, according to a handout issued by the party earlier, questioned whether the right of a fair trial also mandates a corresponding duty to abide by the verdict of a fair trial, which cannot be violated by the NA speaker.
It argued that the ruling cannot be protected under Article 69 of the Constitution “by any legal stretch of imagination”.
PTI’s petition
PTI filed the petition in the Supreme Court through senior lawyer of the court, Hamid Khan.
The petition seeks replies from four respondents: Dr Mirza, Gilani, federation of Pakistan and Election Commission of Pakistan.
The petition states:

Court may graciously be pleased to declare the decision of Speaker National Assembly as unconstitutional, void and in violation of fundamental rights of access to justice and independence of judiciary. It is further prayed that this honourable court may graciously be pleased to direct ECP to decide the question of disqualification of the Prime Minister, as having been deemed to be have been referred to it under Article 63 (2) and (3)

اگر کل کلاں عمران خان اعلان کر دے کہ، "پارلیمنٹ کے سامنے زرداری حکومت کے خِلاف کپڑے اُتار کر ایک جلوُس نِکالا جائے گا" تو نورا لیگ کی اب تک کی چابک دستیاں دیکھ کر بڑے آرام سے کہا جا سکتا ہے کہ عمران خان سے سبقت لینے کے شوق میں مُبتلا نواز شریف، اسمبلی میں موجود اپنے ارا کین کو فون پر کہہ دے گا کہ فوراً سے پہلے شلواریں اُتار کر ننگے باہر سڑک پر جلوس شُروع کرو میں بھی شلوار اُتار کر پہنچتا ہوں۔

اراکینِ پارلیمنٹ کو اِس میں ’’ننگا‘‘ کرنے کی ایک وجہ یہ ہوگی کہ ہنگامی بُنیادوں پر پٹواریوں کی مدد کے بغیر تو سو بندے اکھٹے کرنا بھی محال ہے اور میچ ٹی ٹونٹی کا ہے، وہ بھی عمران خان کے ساتھ۔

یہ گھبراہٹ میں ذرا سی دیر کو رُک کر اتنی سی بات نہیں سوچیں گے کہ عمران خان نے ’’کپڑے اُتار کر‘‘ جلوس نکالنے کا کہا ہے ننگے ہونے کو نہیں۔
بلکہ عین مُمکن ہے چوری نِثار تو فرسٹ آنے کے چکر میں وِگ بھی اُتار دے۔

اسلام آباد… مسلم ليگ نون کے خواجہ آصف اور پاکستان تحريک انصاف کے چيئرمين عمران خان نے وزيراعظم يوسف رضا گيلاني کو توہين عدالت کيس ميں سزا پر اسپيکر قومي اسمبلي کي رولنگ کيخلاف آئيني پٹيشنز، سپريم کورٹ ميں دائر کردي ہيں، اس ميں وزيراعظم کو کام سے فوري روکے جانے اور نااہلي کا معاملہ اليکشن کميشن ميں طے کئے جانے کي درخواست کي گئي ہے . عمران خان اور خواجہ آصف کي طرف اسپيکر رولنگ کے خلاف الگ الگ پٹيشنز دائر کي گئي ہيں، خواجہ آصف کي پٹيشن کو دائر کئے جانے سے قبل درکار دستاويز کو منسلک کرنے ، کاغذات کي جلد سازي کئے جانے جيسے تقاضے جلد ي ميں پورے کئے جاتے رہے ، دائر کي گئي پٹيشن ميں موقف اختيار کيا گياہے کہ توہين عدالت کيس ميں سزا سے وزيراعظم نااہل ہوچکے ہيں ، انہيں کام کرنے سے فوري روکا جائے، دونوں پٹيشنز ميں وفاق ، وزيراعظم، اليکشن کميشن اور اسپيکر اسمبلي کو فريق بناياگياہے، عمران خان نے پٹيشن ميں حامدخان ايڈووکيٹ کو اپنا وکيل مقرر کيا ہے، اس پٹيشن ميں کہاگياہے کہ اسپيکر کے فيصلے غير آئيني قرار دے کر کالعدم کيا جائے، اس کے ساتھ اليکشن کميشن کو حکم دياجائے کہ وزيراعظم کي نااہلي کا معاملہ طے کرے

گُزشتہ کئی مہینوں کی پے در پے نقلیں مارنے اور بالخصوص آج کی اِس حرکت کے بعد نواز شریف کو ’’نقلی شیر‘‘ کہنے والے حضرات ’’نقلیئہ شیر‘‘ کہا اور لِکھا کریں۔
اگر پھِر بھی کہیں نقلی شیر لِکھا نظر آئے تو خود بخود ذہن میں ہی ہجوں میں مناسب ترمیم کر کے نقلیئہ شیر پڑھا کریں۔

۔’’نقلیئے‘‘ کلاسیکل اُردو میں اُن اداکاروں کو کہتے ہیں جو ممکری کرتے ہیں۔​

یہ عمران خان کے لوگ بہت ہی اخلاق سے گرے ہوئے ہیں.

ان کو بدتمیزی سے باز آنا چاہے.

پہلے جھوٹ بول بول کر لوگوں کو بیوقوف بناتے تھے ، اب تو بدتمیزی بھی شامل ہو گئی.

جلسوں میں رسول اللہ اور اسلام کے حوالے اور فلاحی ریاست کے قیام کے دعوے اور یھاں گندی اور غلیظ زبان - کیا ہمیں یہی کچھ دو گے.
