IT IS CLEAR THAT MAZHAR NIAZ SON MUHAMMAD ISRAR IS EMPLOYEE OF NHA FROM 2017 AND 2018 THESE THREE LETTER SHOWN EXACTLY EMPLOYMENT UNDER THE COMMAND OF NHA .IT IS CELAR THAT THE SUPREME COURT OF PAKISTAN HAS GIVEN CLEAR DIRECTION THREE CONSECUTIVE PERIOD OF 89 DAYS IS ENTITLE TO BE REGULARISED AND REGULARIZATION IN NHA EMPLOYEES-IT IS CLEAR THAT ESTABLISHMENT DIVISION HAS ISSUED CONFIRMATION LETTER AFTER SUCCESSFUL COMLETION OF INITIAL TRAINING OR PROBATIONARY PERIOD SUCCESSFULLY WILL BE CONFIRMED .NOW QUESTION NHA IS REFUSING FROM THE ISSUANCE LETTER –IF THESE LETTERS ARE NOT ISSUED BY NHA WEL IN GOOD BUT IF THE ATTACHED LETTER ARE ISSUED BY NHA THEN IT IS CLEAR THE NHA IS BOUND AS PER SUPREME COURT ORDER AND ESTABLISHMENT DIVISOIN RULES TO BE REGULARISED FROM THE DATE ILLEGAL UNLAWFUL MALAFFIDE TERMINATION OF MAZHAR NIAZ SON OF MUHAMMAD ISRAR WORKED OUT UNDER THE COMMAND OF NHA BURHAN –

  • That petitioner No2 enrolled being trainee engineer in national high way Authority from 2017 to 2018 regular 365 days without single break as the honorable supreme court of Pakistan has defined in case No CP-2737/17 PETITIONER CHAIRMAN NHA it is an admitted fact that as per the policy decision of cabinet division A person who has served the national highway authority(NHA) for three consecutive terms of 89 days is entitle to be regularized
  • That it is fact several months has been hanged for the extension of service but informed VERBLY no further service will be extended.
  • That on citizen portal the complaint was regularly filed on which the respondents commented respected Pakistani citizen the trainee engineer are deployed by contractors against bill no 7( general items) or the consultants firms for the purpose of training of fresh graduate engineers transfer of skills their salaries are being paid by the contractors or the consultant as per provision of main months provided in their bill of amounts upon completion of duration ,the training period with the consultant or contractor stands terminated and the individuals are informed accordingly.it is to be noted here that both the consultants and contactors are private units ,therefore request for regularization against the training in these companies is not valid . regards CPEC WR NHA
  • That the act of National highway Authority clearly defined as employee of national high way authority
  • An employee exercising an option under Sub-section (2) shall become an employee of the Authority on such terms and Conditions, as may be prescribed by rules or regulations.

  • The Federal Government shall contribute to the pension, Gratuity and final payment of provident fund of a person Absorbed in the Authority under Sub-section (3) in Accordance with the rules of the Federal Government in force At the time of such absorption
  • The honorable Supreme court of Pakistan has clearly defined in case No CP.2737/17 the terms of regularization in NHA one consecutive term of 89 days job will be confirmed.
  • 11. Plans and Schemes: (1) The Authority shall prepare a master plan for the development, construction, operation and maintenance of National Highways and Roads in Pakistan for the approval of the Council.(2) The Authority may frame a scheme or schemes for all or any (i) Construction, expansion, operation and development of National Highways and Strategic Roads;(ii) Research and development in the field of Highways;(iii) Training of the Authority’s employees;(iv) Welfare of the Authority’s employees; and
  • That as per NHA National High Way authority self-made rules the affidavit was required to receive from my son petitioner no 2 On the 1st day of appointment with terms and conditions but did not get nor submitted
  • That petitioner No2 was purely employee of National High Way authority further during deployment another letter issued to petitioner no 2 by ACE violation to order Supreme court of Pakistan clearly barred integration of DUAL Job
  • That petitioner no2 Civil Engineer received initial letter of appointment from National High way authority without terms and condition both letter attached.
  • That the petitioner has been terminated without show cause , without hearing and, without enquiry and also approval from the board.
  • That due to violation to establishment division letter of confirmation and supreme court order the termination of petitioner may please be null and viod and please issue order to reinstate and regularized

it is most respectfully and most humbly prayed that the petitioner No2 termination from job is Illegally, unlawfully, unjustly, wrongly, illegitimately, unfairly may please be reinstated and the termination order may please be null and void as per supreme court and establishment division orders regularized from the date of termination with all back benefits with due promotion
