Lahore: Man jailed for marrying without first wife's consent

لاہور: کنٹونمنٹ کورٹس میں جوڈیشل مجسٹریٹ نے پہلی بیوی سے اجازت لیے بغیر دوسری شادی کرنے والے شوہر کو 3 ماہ قید کے ساتھ ساتھ 5 ہزار روپے جرمانہ بھی عائد کردیا۔

قانون کے تحت دوسری شادی سے قبل پہلی بیوی سے اجازت لینا لازمی قرار دیا گیا ہے۔

رابعہ یوسف نے اپنے وکیل کے توسط سے ایک درخواست دائر کی تھی کہ ان کے شوہر شعیب زاہد نے مسلم فیملی لا آرڈیننس 1961 کے سیکشن 6 کے تحت درکار ان کی رضامندی کے بغیر دوسری شادی کی۔

ان کے وکیل نے گواہ اور دستاویزی ثبوت عدالت میں پیش کرتے ہوئے استدعا کی کہ اس قانون کے تحت ملزم کو سزا دی جائے۔

جوڈیشل مجسٹریٹ نے جائزہ لینے کے بعد اپنے ریمارکس دیے کہ ثبوتوں اور دستاویزات کی روشنی میں ملزم کا جرم ثابت ہوتا ہے۔

مجسٹریٹ نے شوہر کو 3 ماہ قید کی سزا سنانے کے ساتھ ساتھ 5 ہزار روپے جرمانہ بھی عائد کردیا۔

No. Marriage is a religious/social ceremonial matter -- how a state can abolish it. It's beyond its purview however state may refuse to grant it a legal cover.

This 6 decades old act was adopted with much ado to protect first wife/discourage second marriage and to reform Muslim laws. But the time proved that such laws have little impact. Ayub faced of the wrath of molvis and JI but they also learned that such laws are teeth-less. There is no use for either party to turn this matter into a political/religious debate.
