ISLAMABAD (92 News) – Justice Qazi Faez Isa has also submitted a rejoinder to the reply submitted in the Supreme Court (SC) by the Supreme Judicial Council (SJC), which is hearing the presidential reference.

Justice Qazi Faez Isa has once again cast doubt on the impartiality of the Supreme Judicial Council in his 17-page rejoinder to the council’s reply on a petition challenging the presidential reference against the Supreme Court judge.

The judge expressed serious concern over the engagement of the Attorney General of Pakistan (AGP) by the council to submit its reply in the apex court last week.

He raised concerns over attorney-general submitting the reply for the council in the top court. He has claimed that the statement filed by the attorney-general on behalf of the Supreme Judicial Council has been “filed without due authorisation” and in violation of Article 100 of the Constitution.

The petitioner judge said he was under no obligation to declare the income or assets or money trail of his independent wife and children since Pakistani law did not conflate the identities of different family members merely on account of their kinship.

Earlier, Attorney General Anwar Mansoor Khan submitted the reply to the Supreme Court in the reference against Justice Qazi Faez Isa.

He, in the reply, stated that Justice Qazi Faez Isa is real owner of three properties in United Kingdom. “Justice Qazi Faez Isa’s children are ‘benamidar’ and are reluctant to disclose the sources of purchasing the property,” he said.

He also sought exemption for President Dr Arif Alvi and Prime Minister Imran Khan. “Being the Attorney General, it is my responsibility to assist the Supreme Judicial Council,” he said.

Attorney General Anwar Mansoor Khan said the distribution of cheques among the bar councils by the law minister is not wrong. “The allegations of Justice Faez Qazi Isa are just based on assumptions. Accountability and transparency are part of democracy. No one is exempted from accountability,” he said.

The attorney general contended that Justice Qazi Faez Isa’s application is non-maintainable.

On Wednesday, the government had requested the Supreme Court to reject Justice Qazi Faez Isa’s challenge to the filing of a reference against him since it was filed in a lawful manner and did not in any way undermine the independence of the judiciary.

A 45-page rejoinder, furnished by the government, argued that the process of accountability of judges by their own peers enhanced the independence of the judiciary and President Arif Alvi had moved the reference in exercise of his constitutional duties under Article 209(5) of the Constitution.

جسٹس فائز عیسیٰ کے مطابق کراچی میں 1600 مربع گز کا گھرہے جو پچھلے 10 سال سے خالی ہے، بطور چیف جسٹس بلوچستان ہائیکورٹ کوئٹہ اور جج سپریم کورٹ اسلام آباد میں رہائش پذیر رہا ہوں، لندن یا بیرون ملک کوئی جائیداد نہیں اور نا ہی اہلیہ کی دوہری شہریت ہے۔

انہوں نے اپنے جواب میں یہ بھی کہا کہ پہلی جائیداد 2004 میں 2 لاکھ 36 ہزار پاؤنڈ پاکستانی 2 کروڑ 60 لاکھ روپے میں خریدی، دیگر 2 جائیدادیں 2013 میں بالترتیب 2 لاکھ 45 ہزار پاؤنڈ اور 2 لاکھ 70 ہزار پاؤنڈ میں خریدیں، تمام جائیدادوں کی مالیت مل کر بھی کراچی، لاہور اور اسلام آباد کے پوش علاقوں میں ایک کنال کی قیمت سے کم ہے۔

اگر جج یہ ماں لیتا ہے کہ اس کا جواب اس نے دینا ہے کہ وہ پراپرٹیز کہاں سے خریدی گئیں تو حکومت یہ کیس جیت جاتی ہے کہ جسٹس عیسیٰ پر الزام یہ نہیں ہے کہ ان کے پاس اتنے پیسے نہیں تھے کہ وہ جائیداد خرید سکتے اصل الزام یہ ہے کہ انہوں نے اپنے کاغذات میں ان جائیدادوں کو ظاہر کیوں نہیں کیا ، جج کا مؤقف ہے وہ ان جائیدادوں کو ظاہر کرنے کے پابند نہیں تھے​

These pottheads are full of shit. The Judge's lawyer arguments are not finished yet. He contradicted the dates of purchase of the properties. in 2004 , he was not the judge when one of the properties was bought by her wife. His son and daughter bought the remaining two properties in 2013 . He is contesting the arguments that he was bound to declare the assets of his children and wife. Government has done scud all giving proof about the money transferred to purchase the properties if at all .He said that his monthly income from his family run business is more than his annual income from the job . His argument is that these charges are malafide and rose from his decision against Boots and Bongi together in Faiza Bad case. He will give them all the details of the properties but not before taking their underwear.
