Only law, constitution will prevail in the country: CJ

QUETTA: Chief Justice of Pakistan Iftikhar Mohammad Chaudhry late on Thursday said that only law and constitution will prevail in the country and the judiciary will not accept any unconstitutional step being taken by the executive, DawnNews reported.
Addressing a gathering at a dinner reception hosted in his honour by the Balochistan High Court in Quetta, the chief justice said that the issues, which should have been dealt by the executive, are being resolved by the judiciary.
He said that the judiciary was fully aware of its responsibilities and all institutions of the country are bound to act under their constitutional ambit.
Justice Chaudhry regretted over noncompliance of the constitution in the country and vowed to resist any unconstitutional act taken against the judiciary, the parliament or the masses.
The CJ said that he has taken oath under the constitution and will defend it at any cost. “It is the judiciary’s responsibility to make justice available for everyone. Tradition of respecting law is vanishing fast in the country,” he added.
Expressing concern on overall law and order situation, the chief justice said the country was presently facing the worst kind of lawlessness, bloodshed, kidnapping for ransom and disregard for the supremacy of the constitution.
He also emphasised on implementation of the constitution in Balochistan as elsewhere in the country.
In the ongoing rift between the judiciary and the executive, President Asif Ali Zardari earlier on Thursday had signed a new bill into law providing blanket immunity to top government functionaries for their executive actions.
Moreover, the Supreme Court ruled that Prime Minister Raja Pervez Ashraf must write to Swiss authorities to reopen multi-million dollar corruption cases against the president.
The apex court had also dismissed PM Ashraf’s predecessor Yousuf Raza Gilani as prime minister on June 19 after convicting him of contempt in April for refusing to write the letter.

This is the difficulty, the Parliament is supposed to make laws to protect the people of Pakistan and for that they need to make laws which will be used to punish terrorist unfortunatley there are no such laws and this parliament is trying to make laws to upset the judiciary and NOT to punsh the terrorist. Courts can only use existing laws and rule them in accordance with constitution or not BUT the laws have to be drafted, and that is by the parliament!

Please before you hurl blame left and right try to be educated about the situation so that you can state the right arguments.

This is no tamacha on government face but a most dangerous moment in history of pakistan. CJ is doing his job but who is going to inform and educate public to support his stance? Also he needs to make clear to people that this government is trying to take out the quranic supremacy from the constitution of pakistan by stealth, the very purpose for which pakistan was created ie to help muslims live by the quran and attain and maintain peace=islam.

This is a matter for serious public consideration and public must deal with it and put the government back in its proper place but if they remain sleeping they will wake up to a new pakistan that will have nothing to do with islam.

The end of quranic supremacy in pakistan will make pakistan another bangladesh ie a country without religion. Even western nations are trying to turn back the clock due to problems secularism based democracy has created for them.

If the quran loses its rightful place in pakistani constitution then it is not only a huge loss for paksitani muslims but the humanity as a whole will have no future to look forward to.

This will be end of islam and muslims if muslim do not stop being stupid and take all necessary actions to secure their future by securing the quran as the sole constitution of pakistan. Amending all other clauses that give rise to any contradictions between articles of the constitution that munaafiqeen use to take undue advanatge of.

hm, i am uneducated person...lol...but sir if you read so called Islamic constitution....i wonder no law exist to catch corrupt person, murder, robber...what happen to Gujranwala brother killed public ally....i wonder no law exist in Islamic Republic of Pakistan and this is Supreme court......sir there is phrase in society...don't hire lawyer, instead hire Judge...rule of law...lol

You have to ask the parliamentarians about that, they make the laws I don't.
I am absolutely behind this demand that all terrorist should be punished but the courts can only follow or interpret the law, they can not make the law.This is where the problem is.
Who disagrees with the point that stop asking for money from US or west and who wants to be a part of this madness imposed upon us by a dictator and then loyally followed by the psuedo-democracy whic was supposed to get us out of it?
