PM must write to Swiss authorities before 25th July, SC Orders

The Supreme Court, rejecting the attorney general’s reply on behalf of Prime Minister Raja Pervaiz Ashraf, ordered the premier to write the letter to Swiss authorities and submit a report to the court by July 25, Express News reported on Thursday.

The court stated this in its order issued during the National Reconciliation Ordinance (NRO) implementation case hearing.

The order, also hinting at a contempt of court notice, stated that laws applicable to former prime minister Yousaf Raza Gilani were also applicable to the current prime minister and if he did not implement the court’s order, action would be taken against him in accordance with the law and the constitution.

Earlier, unable to submit a reply from Ashraf, Attorney General Irfan Qadir said that once the Law Ministry sent the summary, only then would the cabinet be able to come to a decision.

The attorney general, during the hearing of the National Reconciliation Ordinance (NRO) implementation case said, “I believe the prime minister and the cabinet will decide together.”

The case was being heard by a five-member bench presided over by Justice Asif Saeed Khosa.

When Justice Khosa replied saying, “You mean first the Law ministry will give its suggestion then the cabinet will decide?” the attorney general said that since the law minister and secretary were new, the cabinet would reflect upon the matter and give a final decision.

He further told the court that he had to leave the country and asked that the case be heard afterwards, adding, “I am sure that the cabinet will have made a decision by then.”

“You have given us your response, now wait for ours,” Justice Khosa remarked and had reserved his verdict on the attorney general’s reply till 3:30pm.

Re: NRO case: SC tells Ashraf to write letter, submit report by July 25

So again the same game dates and "no one obeys" .. this all is wasting time of the nation.. Perhaps SC should start proceedings directly about immunity and decide if anyone has immunity or not.. I think its against the human rights.. Quran and sunnah. so if SC give a decision that no one is Holly cow then the time in requesting each PM to write letter can be saved !!

ISLAMABAD: The Supreme Court on Thursday ruled that Prime Minister Raja Pervez Ashraf must write to Swiss authorities, DawnNews reported.
A three judge bench of the apex court comprising Justice Nasirul Mulk, Justice Asif Saeed Khosa and Justice Azmat Saeed Sheikh heard the NRO implementation case.

The court in its order said that it had directed the attorney general to get orders on NRO implementation from the prime minister.
Rejecting the attorney general’s arguments, the court further ruled that it had initiated contempt proceedings against Yousuf Raza Gilani for not implementing its directives.
Ruling that the prime minister was bound to implement the court’s order, the bench adjourned the hearing to July 25.
Earlier during the hearing, Attorney General Irfan Qadir had told the bench that the court’s order had been delivered to the prime minister.
The order has also been forwarded to the federal law ministry, Qadir said.
The attorney general moreover said that the federal cabinet and the prime minister would make a collective decision on the issue of corresponding with Swiss authorities.
The cabinet has requested the law ministry to give its recommendations on the matter, the attorney general said, adding that the recommendations would be presented before it.
The cabinet would then make a decision on the matter in the light of the ministry’s recommendations.
Justice Khosa inquired of the attorney general as to when the ministry would finalise its recommendations.
Earlier on June 27, the bench had given the new prime minister two weeks to indicate whether he would ask Swiss authorities to reopen corruption cases against President Asif Ali Zardari.
The court on June 19 dismissed Yousuf Raza Gilani as prime minister after convicting him of contempt in April for refusing to reopen the multi-million-dollar cases against the president.
Raja Pervez Ashraf was later elected as the new prime minister.
The allegations against President Zardari date back to the 1990s, when he and his late wife, former premier Benazir Bhutto were suspected of using Swiss bank accounts to launder $12 million allegedly paid in bribes by companies seeking customs inspection contracts.
The Swiss shelved the case in 2008 when Zardari became president and the government had been insisting that the president has full immunity.
But in 2009 the Supreme Court overturned the NRO, a political amnesty that had frozen investigations into the president and other politicians, ordering that the cases be reopened.

I do not see this just an issue of power struggle between judiciary and parliament but I am looking at taking out the quran from the constitution of pakistan by stealth.

It is vital that public show their disapproval of government actions and actions of parliament. This in my view is all about breaking up of pakistan quietly without the pakistani public being aware of it. Some one is taking us down the road of destruction and we must stop it by all means possible for us.

This is no longer a matter of corruption of the government and its supporters but about total destruction of pakistan as an islamic state based upon the quran as its constitution. I say, wake up people you are being driven to point of no return.

If the quran is taken out of the constitution as the foundation of it the result will be supremacy of parliament and then judiciary cannot be independent unless it is so declared by act of parliament. This is very very important point therefore people who are lawyer and judges must pay attention to this point if they at all think we need the quran to be proper human beings. Also if the quran loses its rightful place in pakistan then this is the end of islam. Mullahs therefore must forget about their self created stupid divisions and unite and guide ummah in pakstan or that is the end of role for them as well.
