    Egypt’s National Council for Women (NCW) has appealed to the Islamist-dominated parliament not to approve two controversial laws on the minimum age of marriage and allowing a husband to have sex with his dead wife within six hours of her death according to a report in an Egyptian newspaper.

    The appeal came in a message sent by Dr. Mervat al-Talawi, head of the NCW, to the Egyptian People’s Assembly Speaker, Dr. Saad al-Katatni, addressing the woes of Egyptian women, especially after the popular uprising that toppled president Hosni Mubarak in February 2011.

    She was referring to two laws: one that would legalize the marriage of girls starting from the age of 14 and the other that permits a husband to have sex with his dead wife within the six hours following her death.


    According to Egyptian columnist Amro Abdul Samea in al-Ahram, Talawi’s message included an appeal to parliament to avoid the controversial legislations that rid women of their rights of getting education and employment, under alleged religious interpretations.

    “Talawi tried to underline in her message that marginalizing and undermining the status of women in future development plans would undoubtedly negatively affect the country’s human development, simply because women represent half the population,” Abdul Samea said in his article.

    The controversy about a husband having sex with his dead wife came about after a Moroccan cleric spoke about the issue in May 2011.

    Zamzami Abdul Bari said that marriage remains valid even after death adding that a woman also too had the same right to engage in sex with her dead husband.

    Two years ago, Zamzami incited further controversy in Morocco when he said it was permissible for pregnant women to drink alcohol.

    But it seems his view on partners having sex with their deceased partners has found its way to Egypt one year on.

    Egyptian prominent journalist and TV anchor Jaber al-Qarmouty on Tuesday referred to Abdul Samea’s article in his daily show on Egyptian ON TV and criticized the whole notion of “permitting a husband to have sex with his wife after her death under a so-called ‘Farewell Intercourse’ draft law.”

    “This is very serious. Could the panel that will draft the Egyptian constitution possibly discuss such issues? Did Abdul Samea see by his own eyes the text of the message sent by Talawi to Katatni? This is unbelievable. It is a catastrophe to give the husband such a right! Has the Islamic trend reached that far? Is there really a draft law in this regard? Are there people thinking in this manner?”

    Many members of the newly-elected, and majority Islamist parliament, have been accused of launching attacks against women’s rights in the country.

    They wish to cancel many, if not most, of the laws that promote women’s rights, most notably a law that allows a wife to obtain a divorce without obstructions from her partner. The implementation of the Islamic right to divorce law, also known as the Khula, ended years of hardship and legal battles women would have to endure when trying to obtain a divorce.

    Egyptian law grants men the right to terminate a marriage, but grants women the opportunity to end an unhappy or abusive marriages without the obstruction of their partner. Prior to the implementation of the Khula over a decade ago, it could take 10 to 15 years for a woman to be granted a divorce by the courts.

    Islamist members of Egyptian parliament, however, accuse these laws of “aiming to destroy families” and have said it was passed to please the former first lady of the fallen regime, Suzanne Mubarak, who devoted much of her attention to the issues of granting the women all her rights.

    The parliamentary attacks on women’s rights has drawn great criticism from women’s organizations, who dismissed the calls and accused the MPs of wishing to destroy the little gains Egyptian women attained after long years of organized struggle.

    now this is disturbing.. the man who wants to have sex with his dead wife must be taken to some psychiatrist.... like... wifes dead .. can any husband think abt sex.... what an imagination by the new egypt rulers....

    gali to yeh dini parties khud ban gai hain,,,,aap pakistan ka haal dekh lo yeh mullah ya india k pandit hamari nations ko progress nahi karnay dete.

    Agreed..instead of focusing on big issues, these people will waste all their time arguing with Veena on a TV show or giving fatwas over how to preserve little girl's hymens!

    a blind mullah only can think like that,,,,,,,,,,,imagine,,,,mullahs wife is dead abut he will must do this shaitani game.even dogs and pigs dont do that. i have seen lot of scenes on tv that animals looks very sad after the death of their partener and dont eat or sleep. kia mullahs log k.u.t.o.o.n say bhi bad tar ho gae hain????????

    From Human Rights perspective , 2nd law is just stupid and disgusting....

    sex-after-death is just ..... insane .....


    , btw for marriage .......

    I personally think it should be linked to puberty rather than any specific age.
    So if girls get into adulthood at the age of 14 than there is nothing wrong in it....
    After all in almost all western countries , girls and boys lose their virginity at this age ..... n its very common.... nothing to be surprised
    So why all the fuss for legal marriage at the age of puberty ??

    one point is definitely wrong and unethical from human rights perspective and i dun think so that it would be "islamic" thing to do sex after death :-/ , it cannot be.....
    but for 2nd point , i.e; min. age for marriage , i think it should be decided on scientific(puberty) basis.

    Similar laws are there in different islamic countries who portray themselves as champion of "Shariat".

    Saudi Arabia and Iran are top position holders for this non-sense laws.

    I know you always target sunni countries due to sectarian hatred towards them , but if you consider human rights perspective than Iran is also among the crazy countries who have some really stupid insane laws.

    Just few examples from Iranian Constitution :

    Article 18 of passport law, married women requires their husband's permission to apply for a passport.




    Article 83 of the Penal Code, called the Law of Hodoud, stipulates that the penalty for fornication is
    flogging, i.e. 100 strokes of the lash, for unmarried male and female offenders.

    Article 102 of Iran’s Constitution indicates: "Women who appear on streets and in public without the
    prescribed ‘Islamic Hejab’ will be condemned to 74 strokes of the lash.”

    Article 115 of Iran’s Constitution states the condition for the presidential candidates the law states that:
    “The President must come from among the religious and political statesmen (rejal)." The word rejal
    literally means men of high achievement.


    Article 162 of Iran’s Constitution states the condition for the attorney general. "The head of justice
    department and attorney general must be ‘mojtahed’ [a religious man who is able to issue decree],
    honest, and knowledgeable in legal subject matters."




    Article 209 of Iran’s Constitution states that woman's life is valued only half as much as a man's life. A
    convicted man who has intentionally slain a woman is subject to execution only after the payment of
    "Deyeh" by the family of the victim. "Deyeh" is defined as a sum of money that the victim's family has to
    pay to the assailant's family for the physical damages, dismemberment, or death of the assailant.
    Article 300 of the Penal code states that the "Deyeh" of a Muslim woman is half of the "Deyeh" of a
    Muslim man. By law the life of a woman has half the value of a man in Islamic criminal law in Iran.


    Article 105 of the Civil Code "A woman cannot leave her home without
    her husband's permission, even to attend her father's funeral".


    Article 1117 of the Civil Code states that the husband may ban his wife from any technical profession
    that conflicts with family life or her character.


    Article 1133 of the Civil Code states: A man can divorce his wife whenever he so chooses and does not
    have to give her advance notice.


    Article 102 of the Penal code, states that married offenders (adulterers) are liable to stoning regardless
    of their gender, but the method laid down for a man stipulates he be buried up to his waist, and a woman
    up to her neck.

    Article 114 of Iran’s Civil codes states: When rajm [stoning] is being administered on a man he must be
    placed in a pit almost down to his waist, and when administered on a woman she must be placed in a pit
    almost down to her chest. Such barbaric behavior by the regime includes dictating the style, size and the
    administration of stoning while differentiating between male vs. female victims. Female victim up to her
    neck to avoid physical escape, however, even if condemned female victim is able to flee the scene,
    authorities are obliged to arrest her and execute her by firing squad. As for the male victim


    FACTS and FIGURES


    - Tens of thousands of women have been executed in Iran since 1979, when the mullahs took
    power. They were executed on political grounds, for their opposition to the policies of the ruling
    government. Among those executed were tens of pregnant women.


    - The worst kinds of torture are inflicted on woman prisoners who oppose the regime. These
    include repeated sexual assaults, amputation of body parts and...


    - Women played a very active role in the 40,000 teachers' demonstrations outside the Majlis on
    January 12, 2002. In these series of demonstrations, a number of women were arrested and
    imprisoned on charges of just participating in a demonstration.


    - At least 22 women have been sentenced to stoning or stoned to death during Khatami's tenure
    Girls between ages 10 to 17 are the prime victims of sexual slavery in Iran.

    In Tehran alone, 4000 street girls roam the city on daily basis and are subjected to sexual and physical violence.

    Reports indicate that 90% of the runaway girls end up in prostitution or sold in Persian Gulf human trafficking
    market. Women and girls bare the brunt of Iran's poor economic conditions. 700,000 children, aged 10
    to 14, work in black labor market in Iran.

    The latest statistics released by Iran's Organization of Management and Planning shows that 51% of the country's population live below the poverty line.
    Iran’s deputy Health Minister, Ali Akbar Sayari, admits that 20% of Iranian people go hungry daily. 67% of
    the students deprived of education are girls between 11 and 16 years old. Only 11% of Iranian women
    are employed. The rate of mental and psychological problems among women is almost 26%. In the
    western and southern regions of the country, suicides are mostly self-immolations among women, which
    rates more than 6 in every 100,000 women. In a western province of Iran, deputy of governor on women's
    affairs, Heyran Pournajaf, reports "About 70% of those who commit suicide in Ilam are women.” The
    director general of social affairs of the governor reports that "90% of these women were between 17 and
    35 years old. The real number of suicides is much higher than what we have." The World Health
    Organization has placed Iran on the top 3rd ranking country on death by suicide.
